Fac6 of Law \/ University of Kerbala has discussed the M.A. thesis which is entitled the judge’ role in determining principles of Islamic law appropriate to texts of civil law: a comparative study).<\/span>
\nThe study aims at clarifying compatibility between principles of Islamic law and civil law, in addition to study some terms that are close to the mentioned words and removing confusion between them.<\/span>
\nThe importance of importance of the study lies in justice itself because philosophy and purpose of litigation is based on achieving right and giving each rightful person his due when considering cases presented before the judiciary.<\/span>
\nThe researcher finds out suitability is not determined, and this prompted its definition as a power granted to the judge by law that enables him to determine the legitimate ruling that is most consistent with the provisions of civil law, and this approval changes with change in time, place, and surrounding circumstances.<\/span><\/p>\n
