Abstract
This study deals with the topic (the role of modern technology in detecting and proving crimes of administrative and financial corruption – a comparative study) on the grounds that the subject of modern technology is of great importance at the present time as it has become today one of the most prominent means that are presented as evidence in criminal evidence, due to the rapid developments of modern technological means that have spread widely in society, and given the seriousness of administrative and financial corruption crimes and their negative effects on society in various economic, social and political aspects, it is imperative to take advantage of modern technology and harness it by security and justice men in detecting crimes Administrative and financial corruption and its proof, and our study focused on some types of these means (audio recording, monitoring of conversations, and photography).
In order to understand the topic of the thesis, we first touched on the conceptual framework of modern technology, in terms of explaining its concept and importance in detecting corruption crimes, its most important characteristics, and the most important difficulties in applying it. Criminal evidence, and we ended our research with a conclusion that included many results and recommendations, the most important of which is the failure of the Iraqi legislator to organize these means in a special law and not to indicate the legality of their use and their authority in criminal evidence, so we call on the Iraqi legislator to intervene to regulate these means explicitly, whether by enacting legislation of its own or by amending the current laws to suit this development.
