Abstract:
Among the issues that have been frequently afflicted by taxpayers, in the past and in the present, is the legality and illegitimacy of debates and arguments that take place between masters of arts, sciences and disciplines, even among the general public, even from non-specialists, and the accompanying deviations from Islamic rulings that must be observed. From obligatory, forbidden, desirable, hateful, or permitted, so people began to debate and argue with or without reason, and on various topics, whether the debater was aware of what he was saying or not.
Hence the importance of searching for the jurisprudential rulings that regulate the chaos of debates and arguments, and place them within their legal and moral framework, and refine and purify them from the pests that may be inflicted on them by the Muslim who is not permitted to enter into them, or to be dragged behind them knowingly or negligently.
Through this study, the researcher aims to bring Muslims together on a common word, by clarifying the legal position on controversy and debate, and introducing them to the provisions, controls, etiquette, and scientific foundations upon which these debates and arguments are based. The different schools of jurisprudence, in addition to the inductive and deductive approach in the discussion and establishing evidence on the various jurisprudential rulings, as well as the researcher relied on the logical approach based on the analysis of debates and arguments in a mental analysis, which aims to control the topics on the foundations and controls of sound mental thinking, in order to preserve the debaters from departing from the controls and rules of dialogue Proper and fruitful.
