Faculty of Law at the University of Kerbala has discussed the dissertation which is entitled ” Regulations Governing Foreign Bank Branch: A Comparative Study”. It has been presented by Ghazwa Adel Hussein.
The study aims at clarifying the national laws and their differences in determining the most important element among the elements of attribution, which is relied on in determining the applicable law, which has become unable to respond to the nature of these disputes.
It also deals with the legal and practical reasons that are represented by the occurrence of major economic transformations of the Iraqi economic sector from a closed economy to an open one, which in turn led to changes in the Iraqi banking sector by entering the foreign bank.
The researcher concludes a number of results and recommendations, the most important of which is that banks practice their activities through many banking operations that are associated with a range of commercial contracts that have been given a special nature by banking customs.
