College of Law / University of Kerbala has discussed the M.A thesis which is entitled “procedural defect in arbitration disputes”, submitted by Maa’ Al-Ain Salem Wali.
The study aims at defining types of defects in international arbitration procedures before arbitral institutions or bodies and consequences of these defects in the procedures.
The study concludes that defects in arbitration procedures lead to invalidation of arbitration award or cause it to be obstructed and prolong the dispute.
The study recommends the necessity of accelerating legislation of international commercial arbitration law in Iraq. This is to create an attractive legal environment for international economic and commercial transactions, with attention to spreading culture of interest in arbitration among those dealing with international trade.
