University of Kerbala Discussing an M.A Thesis on Disruption of Civil Law Provisions

Being submitted by Baneen Rasoul Abdul, College of Law, University of Kerbala, has discussed the M.A thesis which is entitled ” Disruption of Civil Law Provisions: A Comparative Study”.
The study aims at determining effectiveness of civil legal system as a measure of a society’s progress and stability. Clarity and adequacy of its provisions are closely linked to achieve justice and ensuring stability of legal transactions. However, this system suffers from a number of structural flaws, including errors, redundancies, inconsistencies, and contradictions.

The study concludes that that jurisprudence does not provide a definition of the concept of suspension, which necessitated adopting method of definition by example, with help of principles of logic. In addition, the Iraqi judiciary does not refer to ruling on suspension in civil cases directly and explicitly, as well as the fact that suspension is considered a judicial remedy as a result of legislative authority’s inability.
