Faculty of Law – University of Kerbala has discussed the M.A. thesis which is (legal system of foreigners’ entry and exit: a comparative study). The thesis submitted by Edris Ali Ward.
The thesis aims at showing that technological development that imposed itself in most countries, and development of means of transportation, which led to the ease of individuals’ movement between the regions of different countries, which generated a direct relationship between this development and the increase in private international trade relations represented by relations between individuals.
The researcher concludes that the state cannot deprive foreigners of any rights required by their residence in that region; because this contradicts what has been established by international law that there is a minimum for all states to abide by, which gives foreigners the rights to continue their lives and residence on the territory of the state. Any breach of this obligation by states, or abuse of this right, exposes the state to international accountability.
