Faculty of Law / University of Kerbala has discussed a the M.A. thesis which is entitled Marital Guardianship.
The thesis submitted by Taghreed Hakeem, shows that marital guardianship leads to stability of family life, at a time when there are calls to end marital guardianship granted to men.
The thesis, in which the researcher follows comparative approach, indicates that ending marital guardianship will lead to fragmentation of bonds of society, of which the family is the main pillar.
The researcher reaches to a number of recommendations, the most important is thatIslamic sects agree on definition of marital guardianship, but they mention provisions that differ from each other.
The researcher concludes that Iraqi personal status law still needs to amend some legal articles related to marital guardianship.
The researcher also called for the need to add a legal article to Iraqi Personal Status Law that clarifies the concept of marital guardianship based on Islamic jurisprudence.
