الخلاصة
يُعدّ تعارض أحوال اللفظ من المواضيع المحورية في تنمية الملكة الفقهية؛ إذ يهدف إلى تعزيز قدرة طالب العلم على التحليل الدقيق للنصّوص الشرعية وفهم دلالاتها، ممّا يؤهله لمواجهة الإشكالات الفقهية المعقدة، يعتمد هذا العلم على منهجية تحليلية تبحث في دلالات الألفاظ عبر ثلاث مراحل رئيسة: مرحلة الأنس، مرحلة الاستعمال، مرحلة الجدية، أمّا في مرحلة الأنس فيتم الاعتماد على المعاني المألوفة والمشتركة لتجاوز التعارض الظاهري بين الألفاظ في هذه المرحلة، تمت معالجة التعارض القائم بين مبدأ الاشتراك وعملية النقل، وفي مرحلة الاستعمال، تُستعمل مرجحات مثل قاعدة الأغلبية، والشهرة، والأقوائية، والقرائن السياقية، وغيرها، لترجيح أحد المعاني على الآخر، وفي هذا السياق، أشرنا إلى مجموعة من الأحوال الّتي تتسم بالتعارض، سواءٌ أكان هذا التعارض داخلياً مع ذاتها أم خارجياً مع غيرها، ومن بين هذه الأحوال، المجاز والإضمار، وكذلك بين التخصيص والاشتراك والنقل، وغيرها من المفاهيم، أمّا في مرحلة الجدية، فيتم الاعتماد على قاعدة الظهور، وغيرها، وفي هذا الإطار، قمنا بتسليط الضوء على عدد من القضايا المتعارضة الّتي تشكل محوراً مهماً في الدراسات الأصولية والفقهية، ومن بينها: التخصيص والتخصّص، والإطلاق والتقييد، فضلاً عن التصرف في الجهة أو الصدور، كما تمت الإشارة إلى الأثر العميق الّذي تُحدثه هذه الأحوال على فهم وتفسير الأوامر، والمفاهيم، وما يترتب على ذلك من تطبيقات أصولية وفقهية واسعة النطاق، والترجيح بينها، واستخراج المعاني المقصودة بدقة، ومن نتائج البحث في هذا العلم تحقيق شمولية في تحليل النصوص، وزيادة الفائدة العلمية في حل التعارضات الفقهية، وتعزيز القدرة على الترجيح بين الأدلة المتعارضة، ممّا يثري البحث الفقهي ويدعم اتخاذ القرارات الشرعية المستنيرة.
Conflicting Indications of Linguistic Usages According to the Jurists
Abstract
The science of the conflict of verbal states is considered a pivotal field in developing the jurisprudential acumen، as it aims to enhance the ability of the student of knowledge to accurately analyze legal texts and understand their implications. This prepares them to address complex jurisprudential issues. This science relies on an analytical and inductive methodology that investigates the meanings of words through three main stages: the Stage of Familiarity, the Stage of Usage, and the Stage of Seriousness, In the Stage of Familiarity, familiar and common meanings are relied upon to overcome the apparent conflict between words. In this stage, the conflict between the principle of sharing and the process of transmission is addressed. In the Stage of Usage, criteria such as the majority rule, fame، strength, contextual clues, and others are employed to prefer one meaning over another. In this context, a range of conflicting states has been discussed, whether the conflict is internal within itself or external with others. Among these states are metaphor and implicit meanings, as well as the distinction between specification and sharing, transmission, and other concepts. In the Stage of Seriousness, the rule of visibility and others are relied upon. In this framework, we shed light on several conflicting issues that constitute a significant focus in foundational and jurisprudential studies, including specification and specialization, generalization and restriction، in addition to actions concerning direction or issuance. We also pointed to the profound impact these states have on understanding and interpreting commands, concepts, and the subsequent broader foundational and jurisprudential application,The research findings in this field achieve comprehensiveness in text analysis, increase scientific benefit in resolving jurisprudential conflicts, and enhance the ability to prefer among conflicting evidences, thereby enriching jurisprudential research and supporting informed legal decisions.
