College of Law, University of Kerbala has discussed the Ph.D. dissertation which is entitled ” hospitalization contract – a comparative study”
Being submitted by Huwayda Abdullah Ibrahim, the study aims at clarifying the most important legal provisions that regulate medical hospitalization contract, and determine its pillars that private hospital is responsible for in case of breaking that contract.
The dissertation concludes that Iraqi legislator does not enact a special legislation for medical liability, and medical hospitalization contract is an unnamed contract and does not address regulation of its provisions either by a special law or by special texts included in medical legislation, and hospitalization contract is characterized by a set of characteristics that distinguish it from other contracts, as it is one of the contracts based on personal consideration and has a humanitarian orientation.
